Use of MCARETECH MCARETECH is intended for wellness purposes only and is not intended for use in the diagnosis of disease or other conditions, or in the cure, mitigation, treatment, or prevention of disease. MCARETECH and any information and/or services provided by its preloaded applications are not intended for use in the detection, diagnosis, monitoring management or treatment of any medical condition, disease or vital physiological processes or for the transmission of time sensitive health information. Any health related information found herein and in any materials or information acquired and/or accessed through MCARETECH and its preloaded applications is available only for your convenience and should not be treated as medical advice. Users should seek any medical advice from a physician, in particular before embarking on any new lifestyle or regimen and users should not self-diagnose any ailment. Unless otherwise expressly stated or legally required, MCARETECH with preloaded applications is provided with no warranties. Any information that you obtain from use of MCARETECH or an application preloaded within may not be suitable, accurate, complete or reliable. The terms of the End User License Agreement accompanying your device, including but not limited to its arbitration provisions, apply to your use of MCARETECH. MCARETECH is intended to help users manage their overall health through applications that capture or track fitness or wellness information and metrics and provide access to articles and similar materials that may interest users. MCARETECH also encourages users to manage health effectively and offers tools to assist users. MCARETECH also provides shortcuts of certain designated applications that a user downloads to his/ her device. All information provided by any and all preloaded applications is for general recreational purpose only, and MCARETECH do not accept any responsibility for its accuracy. You acknowledge and agree that the available functions, features and addable applications for MCARETECH may vary from country to country due to different local laws and regulations. You should check the features and applications available in your specific region before use. You can also You acknowledge and agree that MCARETECH Web Service can be changed or discontinued without prior notice. Connecting Third Party Devices and Programs Your use of third party devices and third party software that connect to MCARETECH and its preloaded applications are solely between you and the applicable third party. You should read and examine such third party’s terms of use and privacy policies before you use MCARETECH and any of the preloaded applications in connection with such third party devices and software. Proprietary Rights and Licenses All articles, text, software, music, sound, photographs, graphics, video, page layouts, design and other material available on or through MCARETECH and its applications and all intellectual property rights therein (collectively, "MCARETECH Contents and IPR”) belong to Medicore or third party licensors. Except as expressly provided herein, you are not entitled to use and shall have no interest in these MCARETECH and Contents and IPR, or any data generated by other users of the MCARETECH. You acknowledge that you have only a revocable and limited right to use MCARETECH web service subject to these Terms and Conditions. You are not permitted, except where expressly authorized in writing to do so, to change, adapt, copy, store, publish, rent, license, sub¬license, sell, hire, lend or distribute in any way any of these MCARETECH Contents and IPR, or to do any other act or omit to do any other act which may harm or otherwise prejudice any of these MCARETECH Contents and IPR. No MCARETECH Contents and IPR may be distrib¬uted or copied for any commercial purpose. No MCARETECH Contents and IPR may be decom¬piled, reverse engineered or reproduced or transmitted to or stored in any other website or other form of electronic retrieval system. Disclaimer of Warranty MCARETECH AND ANY CONTENTS THEREIN ARE PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND FROM MCARETECH OR ITS THIRD PARTY LICENSORS, EITHER EXPRESS OR IM¬PLIED. TO THE FULLEST EXTENT POSSIBLE PURSUANT TO APPLICABLE LAW, MCARETECH DISCLAIMS ALL WARRANTIES EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY OR FITNESS FOR A PARTICULAR PURPOSE, RELIABILITY OR AVAILABILITY, ACCURACY, LACK OF VIRUSES, NON INFRINGEMENT OF THIRD PARTY RIGHTS OR OTHER VIOLATION OF RIGHTS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM MCARETECH OR ITS AFFILIATES SHALL BE DEEMED TO ALTER THIS DISCLAIMER, OR TO CREATE ANY WARRANTY OF ANY SORT FROM MCARETECH. This MCARETECH Privacy Notice explains the privacy practices of MCARETECH Co., Ltd. ("MCARETECH: “we: “us,” “our”) with respect to the information collected through the Smart Pulse application, connected applications and associated accessories ("MCARETECH"). 1. WHAT INFORMATION IS SHARED WITH US If you use MCARETECH Web Service without logging in to your account, we collect and store the following information that you provide directly or generate through your use of Smart Pulse: - birth year - gender, reference type - height weight and activity levels - device information including identifiers - firmware version of device - application version and major setting values for the Smart Pulse application - in-app usage information such as menus and settings clicked, features used and any errors displayed - If you use MCARETECH web service while logged in to your account, we may collect and store the following additional information that you provide directly or generate through your use of MCARETECH web service: - connected accessories make, model, identifiers - profile and activity-related information such as user name, date of birth, profile photo, postings - fitness and nutrition-related information such as types of exercises, food, drinking, smoking - wellness-related information such as heart rate, heart rate variability, stress level, APG(accelerated plethysmography), type of blood vessel information - location information 2. WHAT WE DO WITH THE INFORMATION WE COLLECT We use this information to provide services or features that you request, including data back¬up and sync services for MCARETECH account users, to offer customized content and recommendations, and to provide optimized service combined to compatible MCARETECH services. We may also conduct data analysis and statistics to improve our services. `With your consent, we may send promotional push notifications to your mobile device (you can change your notification settings at any time in the settings menu of Smart Pulse application). 3. TO WHOM DO WE DISCLOSE YOUR INFORMATION We will not disclose your information to third parties for their own independent marketing or business purposes without your consent. However, we may share your information with our affiliates and service providers as necessary for the purposes of providing the MCARETECH services and features as described above. We may also disclose your information to a third party where we have a legal obligation to do so. 4. CONSENT TO INFORMATION ABOUT INTERNATIONAL TRANSFERS By using MCARETECH service, you consent to the collection, transfer, storage and processing of your information collected by MCARETECH outside of your country of residence (including, in par¬ticular, South Korea), consistent with and for the purposes described this Privacy Notice. 5. HOW TO DELETE YOUR INFORMATION When you delete the Smart Pulse application, the information saved in your device will be deleted but any information collected and stored by us will still remain in our MCARETECH server. If you want to delete the information from our MCARETECH server, you can do so by going to my account and selecting ‘close my account’. However, any third party applications you have authorized us to share or synchronize your information with may continue to store your information subject to their own privacy policies and practices. By selecting ‘I agree’, you confirm that you have carefully read and understood all terms and conditions of this Privacy Notice, and you hereby give your consent to the collection, use, storage, sharing, disclosure and other processing of your personal information, including your sensitive personal information, in accordance with the terms set forth in this Privacy Notice.
